Mahiga: Package of EAC laws 78 so far

THE East African Legislative Assembly (EALA) has enacted a total of 78 laws since its inception in 2001, the Minister for Foreign Affairs and East African Cooperation, Dr Augustine Mahiga, disclosed here yesterday.
 
Responding to a basic question before the National Assembly, the minister pointed out that 20 of them had been ratified by heads of member states of the bloc, while others were at different stages of being signed and endorsed.

According to him, the enacted laws aimed at strengthening business, promoting economic growth among member states of the East African Community (EAC) and enabling institutions and other organs of the Community to carry out their mandate.

Some of the laws are East African Customs Management Act, 2004, the East African Community Elimination of Non-Tariff Barriers Act, 2017, the East Africa Community Vehicle Load Control Act, 2013 and the East African Community One Stop Border Posts Act, 2013.

In the basic question, Ally Saleh Ally (Malindi- CUF) explained that the procedure of enacting laws in the East African Community touched the interests of all six member states of the community towards the envisaged economic and political integrations.

He, therefore, wanted to know how many laws had been enacted and under what areas. The lawmaker further sought to know measures that had been taken where there had been conflicts of laws between those of partner states and those of the EAC.

Delving deeper, Dr Mahiga told the House that under Article 8 (4) of the Agreement for Establishment of the East African Community, the bloc’s laws overrode those of member states.

He explained, therefore, that in the event of conflicts, member states were required to review their laws so that they could be in line with those of the EAC. On Tanzania’s part, the minister said, several laws relating to tax were amended under the arrangement.

Such amendments were to align with the East African Customs Management Act, 2004, the law which is enforced in all member states of the East African Community. Furthermore, the minister said,

in order to comply with the agreement reached in the Joint Market Protocol, the government of Tanzania had made amendments on the Capital Market and Securities Act, Cap 79 and the Foreign Currency Exchange Act, Cap 271.

He pointed out further that the government also enacted the Non-Citizens (Employment Regulations) Act No. 1 of 2015 and that the government would continue to review various laws in order to harmonise them with those of the Community
