Court of Appeal upholds DPP powers in bail denial

Image
THE Court of Appeal has upheld the Director of Public Prosecutions (DPP) powers to deny bail to persons charged with economic and organised crime related cases. Justices Mbarouk Mbarouk, Richard Mziray and Rehema Mkuye, in their recent judgment, dismissed an appeal by Reli Asset Holding Company (RAHCO) Company Secretary Emanuel Massawe against the refusal by the High Court to grant him bail in the economic case he is facing. In its decision, the court denied bail to Massawe for sole reason that once the DPP has filed a certificate in terms of section 36 (2) of the Economic and Organised Crime Control Act, objecting bail, the court could not entertain such bail application. The justices concurred with the High Court verdict that once the DPP has validly filed the certificate under section 36 (2) of the Act, it bars the trial court from granting bail to the accused. “We are of the considered view that it is not the requirement of the law for the DPP to give reasons for objecting b

JPM ideas take effect … great wall goes up around tanzanite mine

Image
AFTER the works to build a concrete wall measuring 24.5km around the Mirerani mining quarries are complete, a new capping project to install the fort with live electric wires around the entire distance will soon start. “… according to the president’s (Dr John Magufuli’s) directives, the 3.2m wall is not enough to keep off intruders … the fort needs to be reinforced with electric fencing as well as surveillance cameras and other security related electronics,” says the Chief of Defence Forces, General Venance Mabeyo, who recently visited the ‘Great Wall of Mirerani.’ The wall is regarded as ‘floodproof’ because all the waterways which used to cause havoc during the rains have since been sealed off – providing just a single entrance and exit gate to ensure that security is maintained. Last week, the CDF met heads of security at the ‘Great Mirerani Wall’ built specifically to protect the rare Tanzanite gemstones – found only at that area across the world. “We would like the Commande

Mr Kalunga said the five-year campaign was also aimed at encouraging parents and guardians to join hands with the government and Non-Governmental Organisations (NGOs) in initiatives to curb child marriages, to enable girls complete all levels of education, as a curtain raiser for a bright future. “The campaign has registered considerable achievements in districts whic

JPM’s order yields results as coop union gets assets

NYANZA Cooperative Union (NCU) has repossessed assets worth 9.5 bn/- that had been sold at throwaway prices to some Mwanza-based businesspeople, thanks to interventions by President John Magufuli. Speaking in an exclusive interview with the ‘Daily News’ on Monday, NCU General Manager, Mr Juma Mokili said the assets were undervalued before sale, occasioning huge losses to NCU. According to Mr Mokili, the decision to repossess the assets was reached after their value was assessed afresh by the State valuer. He said the restoration of the NCU assets was an outcome of the execution of the order the President issued on September 8, 2015 during the presidential election campaign in Mwanza city. “The President was irked by the decision to sell the NCU assets, prompting him to order for their return to the members. We are very delighted to announce to the members that the assets have already been restored,” he said. He mentioned the assets as Kauma building that was sold at 72m/- , New Era fa

WHEN did you last visit your grandma? Well over 200 of them are currently gathering in Arusha where Tanzania joins Uganda in becoming the first East African Countries to pay attention to predicaments faced by ageing women. TARIME District Council has timely implemented Prime Minister Kassim Majaliwa’s directive to the local government, with support of the North Mara Gold Mine, to open a new hospital at Nyamwaga village.   Several people thronged the new facility for medical services, after opening its doors for the first time on Friday. “We have implemented the directive issued by the Prime Minister. We have started providing services at the hospital today”, Tarime District Council Executive Director (DED), Mr Apoo Castro Tindwa told the ‘Daily News’. The newly built hospital is equipped with modern medical equipment capable of diagnosing some of complicated diseases, easing the agony that many people endured by travelling to the faraway regional hospital for attention. Plans are underway to upgrade the new facility to a district hospital, according to Mr Apoo. “The new facility has modern medical equipment”, DED Apoo said. During his tour of Mara Region last month, the prime minister directed that the

Tourism sector job segregation decried

Image
BACKBENCHERS in the House of Representatives are still unsatisfied with job allocation to Zanzibaris, saying people from outside Zanzibar dominated employment opportunities. Mr Omar Seif Abeid (Konde) and Mr Simai Mohamed Said raised their concerns, saying many young people in the Isles, including graduates from the Tourism College, were not employed by tourist hotels without clear reasons. “We have been complaining about offering jobs to people from outside Zanzibar in the tourism sector. Even jobs that can be managed by ordinary citizens, are held by foreigners. This is unacceptable; tourism industry should benefit citizens fast,” Mr Abeid remarked.. It is alleged that hotel proprietors preferred Tanzania mainlanders, as well as people from Kenya, South Africa, India and Europe because they were hardworking and adhered to punctuality. In response, the Deputy Minister for Labour, Economic Empowerment, Elders, Youth, Children and Women, Ms Shadya Mohamed Suleiman, said there had

Two jailed for insulting JPM

Image
THE Mbeya Resident Magistrate’s Court yesterday sentenced the Member of Parliament for Mbeya Urban under Chadema, Joseph Mbilinyi, alias Sugu and the opposition party’s Zonal Secretary, Emmanuel Masonga, to five months in jail each for insulting President John Magufuli. Resident Magistrate in Charge of the Court Michael Mteite, imposed the sentence after convicting the duo of the offence, having being satisfied by the evidence tendered during the trial by prosecution witnesses. In the well attended session, where the judgment was delivered for almost two hours, the magistrate said that the prosecution sufficiently discharged their duty of proving their case beyond reasonable doubt, that they actually committed the offence. He said that it is true that they uttered the offensive words, which were directed to the head of state, Dr Magufuli. The prosecution’s evidence, he noted, was supported by witnesses who had heard the utterances. During the defence hearing, the second accused had

Adultery case against Mwingira thrown out

Image
THE Kisutu Resident Magistrate’s Court in Dar es Salaam yesterday dismissed with costs the suit lodged by American doctor William Morris, demanding 7.5bn/- damages from Prophet Joseph Mwingira, for allegedly committing adultery and unlawfully cohabiting with his ex-wife, Dr Phillis Nyimbi. Senior Resident Magistrate Godfrey Muhini said that Dr Morris, who was the plaintiff in the suit, failed to prove the adultery relationship between Prophet Mwingira, who is the Chief Executive Officer of Efata Ministry, the first defendant and Dr Nyimbi, who was the second defendant in the matter. “He (the plaintiff) also failed to prove that the child of the second defendant (name withheld) was the result of the adultery relationship with Prophet Mwingira,” the magistrate said in the judgment read on his behalf by Principal Resident Magistrate Thomas Simba. The court concluded, therefore, that the American doctor was not entitled to any damages as claimed in the plaint of the suit, except to

Dodoma ‘fire lady’ blames carelessness

Image
DODOMA Fire and Rescue regional commander, Ms Regina Kaombwe said yesterday that the increase of fire outbreaks incidents were a result of ‘laissezfaire’ arguing that people do not seek ‘safety clearance permits’ for their architectural drawings. Speaking to reporters here, Ms Kaombwe said that according to a recent study, most fire victims report incidents only after failed attempts to put it off – then belatedly choose to call the fire brigade. She also said that most fires were caused by people who left electronic gadgets on the switch, especially during the night when they fall asleep – so the devices get heated, or blow out and cause fires. For the past one year, for instance, a mere five architectural drawings had been sent in for clearance at the fire and rescue brigade. “… this gives us immense challenges … we are doing our best to educate the public on the importance of observing the safety measures and switch off their electrical devices when they go to bed” said Ms Ka

Dodoma sets to resume sale of residential plots

Image
DODOMA Municipal Council is placed to resume the sale of its residential plots later this week after a similar process was put off just weeks after the government ‘killed’ the Capital Development Authority (CDA) in May last year. Thereafter, Dodoma regional authorities indefinitely suspended the sales or donation of unauthorised plots, defending the motive as protecting the new designated capital from unplanned settlements which had engulfed dozen of towns and cities. But speaking to the ‘Daily News’ here yesterday, Dodoma Municipal Director Godwin Kunambi said the new authority is now putting at least 15,000 plots for sale from next month. “… We’ll start next March ... we’ll remain open as long as we have the plots,” he said, adding that the municipal council was committed to map and survey at least 45,000 plots every year. According to Kunambi, the new plots will also include cheap plots for ordinary Tanzanian to afford. But “we will also have a high price on some locatio

Use charcoal wisely, DC counsels Kilosa

KILOSA District Commissioner Adam Ngowi has urged village leaders, municipal authorities and district councils to ensure a project on transforming Tanzania’s charcoal sector achieves its goals. He was speaking on Friday during a tour of a project site at Ulaya Mbuyuni village within the district, Morogoro region, asking village councils to exercise their responsibilities in ensuring the project were sustainable and well preserved. “… we all know that charcoal and fuelwood energy are the most important energy sources used by most residents in Kilosa District … so this project is one of its kind … it must be managed and monitored by village leaders to achieve that goal,” he said. The DC added that forests were among resources that contributed to boosting development within the district, saying the TTCS projects would help create more awareness on forest conservation and increase income to households. He directed the municipal directors to collaborate with village council in allocating

Call for better health, safety at workplaces

Image
THE Occupational Safety and Health Authority (OSHA) now wants to convince the public and private sector to formally recognise and incorporate health and safety at the workplace. The new plan was given ‘green light’ by acting OSHA Chief Executive Officer Ms Khadija Mwenda when addressing graduates at the National Occupational Safety and health course in the city this week. She said that officials from OSHA were still not recognised and respected by some employers, arguing that was holding back implementation of the Occupational Health and Safety Act, 2003. “The legislation categorically insists that employers should form safety and health committee whose members are representatives of the workers,’’ she insisted. Section 13 (1) of the same law says that an employer shall in respect of each factory or work place where two or more health and safety representatives have been designated, establish one or more committees and, at every meeting of such a committee, at every meeting

TANESCO now boasts enough power supply in Kilimanjaro

Image
ELECTRICITY supply within Kilimanjaro region has been described as ‘good enough’ to meet the requirements of new industrial investments. The good news was announced by Tanzania Electric Supply Company (Tanesco) regional manager Eng Mahawa Mkaka, this week, when briefing Kilimanjaro Regional Commissioner, Anna Mghwira, when the latter visited the company’s power supply stations. “… we can now generate some 135MW of electricity for use in Kilimanjaro region … our demand so far stands at just 34MW … so we’ve an excess of more than 80MW which could serve potential investors … for at least ten years to come,” he said. Eng Mkaka added, “This good condition is based on installations of new electricity supply infrastructures which managed to address challenges which affected power supplies within the region in the past”. Commenting on the challenges facing the power utility in the region, Eng Mkaka said they included that of some of the clients whom he said owed the company millions of
